Terms and Conditions

Smooth Hoperator PTY Ltd is an accredited tour operator entity ACN: 18 661 133 133.

1.1: By making a booking for a distillery and/or brewery tour with Smooth Hoperator’s you are agreeing to the Terms and Conditions set out in the schedule, and agree to abide by them as if they were a binding contract without alteration. Noting that the Agent is responsible for conveying these terms and conditions to all parties partaking in the event.

1.2: Smooth Hoperator reserves the right at any time to alter the conditions of their terms and conditions at any time, and it is the client’s responsibility to ensure that they are aware of the conditions.

1.3: A version of the latest terms and conditions in relation to our company will be readily available from https://smoothhoperator.com.au/, which will include the most up-to-date version.


1.4: ‘We’, ‘us’ or ‘our’ refers to Smooth Hoperator Tours.

1.5: ‘Guest’ means a person who is aged 18years or older who has made the booking and paid for the relevant tour.

1.6: We reserve the right to at any time increase or decrease the advertised prices in relation to our tours.

1.7 Bookings – in order to be booked on the tour you must receive a confirmation email, if you don’t receive one then you’re not booked on the tour.

1.8 All Prices are quoted in Australian dollars and include GST.

1.9 Any extra drinks or food not listed in the inclusions will need to be paid for by the guest’s or third-party.

  1. If you miss the tour on the day no refund will be given.

2.1 Price is quoted in Australian dollars 3% credit card surcharge applies for Visa & MasterCard which covers transaction/overseas credit card fees. We do not accept diners, AMEX or travellers’ cheques.

2.2  All pricing found on our website supplants any previously advertised pricing.

2.3 Cancellations or Changes by Guest

– If for any reason you need to cancel your tour, please notify Smooth Hoperator as soon as possible via email: info@smoothhoperator.com.au and phone 0476 951 741.

2.4 Our Cancellation and Refund policy is as follows:

For all Private Group Tours – Hens – Bucks – Christmas parties;

-In regards to 14 days or less there will be no refunds distributed.

-If you cancel your booking 15-28 days before tour we will issue a 50% refund of money paid.

-In the event a cancellation is to occur over the 28 day period a refund will be issued that is less than the non-refundable fee.

-For individuals that cancel in the group due to covid sickness, a partial credit will be issued to use within a 1-year period.

-Custom tours will only be transferrable with the written consent of Smooth Hoperator only.

For public day tours booked directly on the website;

-A cancellation fee of 100% will apply if canceled 7 days or less to tour departure date. 50% payment will be refunded if canceled 8-28 days prior to tour departure, and full refund is provided if canceled 29 days or greater from tour departure date.

-If you need to cancel due to Covid sickness, a partial credit will be issued to use within a 1-year period.

2.5  Cancellation or Changes made by ‘us’

-Smooth Hopperators reserves the right to cancel or change tours due to operation and circumstances beyond our control.

-We operate tours in working breweries; however, we cannot guarantee that all elements of the brewing process will be operating at the time of the tour/s.

-All of our public tours require a minimum of (4-6) guests to commence, if the minimum amount is not reached, we reserve the right to change or cancel any booking.

-All fares and prices are valid from 1st November 2021 – 1st December 2022. All prices are shown in Australian Dollars, include GST and may be subject to change.

-In the event of weather that makes it impossible to carry out the activity safely, an alternative activity may be given and if one alternative is not suitable then cancellation will occur and a refund will be given.

– If we cancel a tour, we will endeavour to do one of the following:

– Rebook you for another date or tour (Subject to availability).

– Transfer your booking to another person.

– Refund your payment.

2.6 Refunds

Refunds will not be issued except in accordance with these Terms and Conditions or as agreed in writing by Smooth Hoperators only.

-Smooth Hopperators will refund in the form a voucher if a reimbursement is required.

-Refund back to the original payment method used.

2.7 Charters & Private Tours

-Smooth Hopperators are available for private tours and special events (please contact us for more information).

-For private tours/charters a deposit is required at the time of the booking (phone for details).

-Dates and activities are not guaranteed until the deposit is received.

-If a booking is cancelled, please refer to our cancellations and refund policy.

-Private group tours incur a $300 bond, noting the bond will be returned five (5) business days after the tour has finished, providing the following:

– The Bus is left clean and free from damage.

– There is no negative feedback from the breweries.

– Nothing was stolen or damaged at any visited venues.

-Smooth Hoperator reserves the right to outsource charters in the event that we are unable to undertake a booking due to vehicle availability, please note that there is a (2) standard drink supply limit on any vehicle owned or operated by Smooth Hoperator Tours.

2.8 Last Minute Deals

-Prices are set as per person per tour and are subject to availability (Discounts may apply to selected tours only).

-Smooth Hoperator reserve the right to discontinue the promotion at any time without notice.

-From time-to-time discounted tours may be offered by us as last-minute deals.

-Any discount does not apply to existing bookings and cannot be used with any other discounts.

-The number of places on discounted tours is subject to availability.

2.9 Disabilities

-Smooth Hoperator is not equipt for wheelchair access, however if someone has a visual or hearing disability, we are happy to discuss this further and make allowances (feel free to phone with your enquiries).

3.0 Service of Alcohol

-Smooth Hoperators Tours do not condone excessive drinking or binge drinking and promote the responsible service of alcohol.

-All guests must abide by all state and federal laws regarding lawful drinking practices including but not limited to, Responsible Service of Alcohol (RSA) laws, the consumption of alcohol in public places, in-vehicle consumption of ‘bring your own’ (BYO) alcohol.

-Any guest who consumes, or is suspected of consuming alcohol in a non-licensed area will be removed from the tour, and will not be entitled to any refund.

-Service of alcohol may be refused to persons deemed intoxicated.

-As Smooth Hoperator visits licensed premises where alcohol is served it is your responsibility to carry a valid passport, driver’s license, proof of age card, or another suitable form of identification.

-Any alcohol purchased on the Tour is to remain on the bus and may not be taken into the breweries.

3.1 Behaviour

-You are responsible for your own behavior.

-Uncontrollable, disruptive and dickhead behavior will not be tolerated.

-Any legal action (including fines) taken against a person on the tour, or against Smooth Hoperators because of actions due to a guest, will be the sole responsibility of the guest alone.

-We highly recommend not to drive after engaging in one of our tours and to arrange alternative transport.

-Guests are solely responsible for any damages incurred at any of the premises we visit, and to the property of Smooth Hoperator.

-Sexual harassment of any kind will strictly not be tolerated by any member of our staff.

-A minimum fee of $200 will occur in the event there is large amounts of spillage or vomit on any of our tours.

-We reserve the right to charge your credit card for any damages that are incurred.

-Smoking is not permitted on any of our transport.

-We are not responsible for the behavior of other venues and providers.

-When sitting on as a passenger, the seat belt must be worn at all times during the day.

-The Bus driver will inform you during the day and at the start of the day, but it is the passenger’s responsibility to use the safety belt. All passengers are required by Australian law to wear seat belts at all times as a passenger on a tourist bus.

3.2 Timing & Itinerary

-In the event you have lost property on one of our tours we will attempt to contact you straight away, however if you notice that you have lost something please contact us immediately so we can search lost property, we will hold the item/s for a period of 3 months.

-Departure, you must be 10 minutes early as the bus needs to keep a tight schedule for the pickup run.

-We will not offer reimbursement or partial reimbursement in the event that a guest has failed to meet us at one of our pick-up points.

-We are not responsible for the late arrival to a venue on one of our tours.

-Personal Belongings, whilst every care is taken, we accept no responsibility for belongings left unattended in the vehicle.

-We reserve the right to change a route or itinerary, inclusions, amend times, days and fares for its tours if necessary or withdraw without notice.

3.3 Publicity

-Images and video footage may be taken throughout our tours and may be used on our website for publicity purposes.

-We may also share the content on social media platforms if required.

-By engaging in our tours, you agree for this to occur.

3.4 Privacy

–Smooth Hoperators Tours will need to collect information from you some of which may be of a personal nature, in order to provide a service to you.

-Information may be disclosed to, or collected on behalf of our service providers, and will not be used for any other service.

3.5 Guest Release and Smooth Hoperator Liability

-Each guest releases Smooth Hoperators Tours, it’s employees and agents from liability or loss or injury to the client from any cause, and whether due to the negligence of Smooth Hoperators Tours or any other person.

-Each guest releases Smooth Hoperators Tours from all sums of money, accounts, claims, actions, proceedings, demands and expenses which the client at any time may have against Smooth Hoperators Tours for or by reason or in respect of any act, cause, matter or thing.

-Each guest indemnifies Smooth Hoperators Tours Against:

-All losses incurred by Smooth Hoperators.

-All liabilities incurred by Smooth Hoperators.

-All costs actually payable by Smooth Hoperators to its own legal representatives (whether or not subject to a costs agreement) and other expenses incurred by Smooth Hoperators Tours in connection with a demand, action, arbitration or other proceedings (including mediation, compromise, out of court settlement or appeal); as a result of or in connection with any act or omission of the client.

-We recommend all travellers have adequate travel insurance in the event of delay, illness and loss of property which may result in failure to join or complete our tour.

3.6 Smooth Hoperator Discretion

-Smooth Hoperators Tours may use its absolute discretion in exercising any of the rights granted to it pursuant to these Terms and Conditions.

3.7 Governing Law and Jurisdiction

-The law of Queensland and NSW governs these standard Terms and Conditions. The Parties submit to the non-exclusive jurisdiction of the courts of Queensland and of the Commonwealth of Australia and NSW and of the Commonwealth of Austraila

3.8 Force Majeure

-Force Majeure, Except where otherwise expressly stated in these booking conditions, we regret we will not accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any nature as a result of “force majeure”. In these booking conditions, “force majeure” means any event, or the consequences of which, we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events are not limited to but may include actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, volcanic activity, seismic activity, fire, pandemics, epidemics and all similar events, natural or manmade, outside our control or that of our agents or suppliers.
